In a criminal trial, evidence is used to draw conclusions about what happened concerning a supposed crime. Traditionally, the three main approaches to modeling reasoning with evidence are argumentative, narrative and probabilistic approaches. Integrating these three approaches could arguably enhance the communication between an expert and a judge or jury. In previous work, techniques were proposed to represent narratives in a Bayesian network and to use narratives as a basis for systematizing the construction of a Bayesian network for a legal (...) case. In this paper, these techniques are combined to form a design method for constructing a Bayesian network based on narratives. This design method is evaluated by means of an extensive case study concerning the notorious Dutch case of the Anjum murders. (shrink)

According to the Spatial Quantity Association of Response Codes (SQUARC), people hold a mental association between horizontal position and quantity (lower quantities left, higher quantities right). While a large body of research has explored this effect for response speed and judgment accuracy, the affective downstream consequences of the SQUARC remain unexplored. Aiming to address this gap, the present two experiments (pre-registered, total N = 521) investigated whether stimulus arrangements that are compatible with the SQUARC for luminance are affectively preferred to (...) stimulus arrangements that are incompatible. SQUARC-compatible square arrangements (dark-left, bright-right) were preferred over SQUARC-incompatible square arrangements (dark-right, bright-left). The preference for SQUARC compatibility was not moderated by the horizontal orientation of the response scale. Our results confirm the direction of the spatial-luminance association and provide initial support that the cognitive processing of SQUARC compatibility is hedonically marked and appears sufficient to impact affective evaluations. In a criminal trial, a judge or jury needs to reason about what happened based on the available evidence, often including statistical evidence. While a probabilistic approach is suitable for analysing the statistical evidence, a judge or jury may be more inclined to use a narrative or argumentative approach when considering the case as a whole. In this paper we propose a combination of two approaches, combining Bayesian networks with scenarios. Whereas a Bayesian network is a popular tool for analysing (...) parts of a case, constructing and understanding a network for an entire case is not straightforward. We propose an explanation method for understanding a Bayesian network in terms of scenarios. This method builds on a previously proposed construction method, which we slightly adapt with the use of scenario schemes for the purpose of explaining. The resulting structure is explained in terms of scenarios, scenario quality and evidential support. A probabilistic interpretation of scenario quality is provided using the concept of scenario schemes. Finally, the method is evaluated by means of a case study. (shrink)

Research on the Spatial Quantity Association of Response Codes (SQUARC) has documented associations between spatial position and mental representations of quantity. Large quantities are associated with right and top, small quantities are associated with left and bottom. Resulting compatibility effects have largely been documented for response speed and judgment accuracy. Recently, employing luminance as quantity, Löffler et al. (2022) generalised such SQUARC compatibility effects to affective judgments, showing that horizontally SQUARC-compatible stimulus arrangements (i.e. bright on the right, dark on the (...) left side) are liked more than SQUARC-incompatible arrangements. The present Experiment 1 (N = 296) replicated this horizontal compatibility effect, dz =.18, and generalised it to vertical luminance SQUARC compatibility (i.e. bright on the top, dark on the bottom), dz =.22. Experiments 2a-b (total N = 259; Experiment 2b preregistered) employed stimulus arrangements tilted by 45° to manipulate horizontal and vertical (in)compatibility simultaneously within the same stimulus, finding robust horizontal compatibility effects, but mixed evidence regarding vertical compatibility. In Pro Murena, Cicero argues that Cato’s rigid philosophical comportment to politics reflects a mistaken understanding both of philosophy and of politics. By implication, he suggests that there is an approach to philosophy that is compatible with political leadership. Specifically, he argues that a thoroughgoing commitment to the philosophy of the Platonic Academy (i.e., Academic Philosophy) is entirely compatible with a thoroughgoing commitment to political leadership in the late Roman Republic. This essay looks at the most famous treatment of philosophical (...) leadership in the Platonic corpus, the philosopher ruler of the Republic, and asks to what extent Cicero’s depiction of politics and philosophy is consonant with that account. Based on the 2019 A.V. Elliott Conference on Great Books and Ideas at Mercer University, eleven scholars take up some of the complex questions that emerge when one considers carefully how Plato presents democracy and liberty in the dialogues, particularly in terms of the threats they seem to pose to justice and philosophy. When Athens lost the Peloponnesian War, the Athenian people also lost their democratic constitution for a brief but brutal time. Plato wrote his dialogues and founded his Academy (...) in the early days of Athens's newly restored democratic regime, the regime that executed Socrates. But, he set most of the dialogues in the days leading up to Athens's downfall. Plato presents Socrates as so deeply committed to Athens that he would not consider living anywhere else, even when the Athenians intend to execute him. The authors whose essays are collected in this volume explore these tensions deeply and with great attention to the subtleties and complexities of Plato's texts. (shrink)

Michel de Montaigne begins his magisterial ESSAIS by telling his readers that he, himself, is the matter of his book. He says that he has written himself so that after death he could remain in the world with those who knew and loved him. Montaignes intimate project, meant to be read by friends, has emerged as one of the most surprising and compelling accounts of the human condition ever written. Although Montaigne famously retired from public life to write his essais, (...) neither his concerns nor the activities recounted in ESSAIS is purely private. This volume of essays, based on papers presented at The A.V. Elliott Conference for Great Books and Ideas sponsored by Mercer Universitys McDonald Center for Americas Founding Principles, focuses on the outward oriented political philosophy of Montaigne. Nurses’ experiences in, and the overall effectiveness of, widely used alternative‐to‐discipline programs to manage nurses’ substance‐use problems have not been adequately scrutinized. We uncovered the conflicted official and experiential ways of knowing one such alternative‐to‐discipline program in a Canadian province. We explicated this conflict through an institutional ethnography analysis. Ethnographic data from interviews with 12 nurses who were enrolled in an alternative‐to‐discipline treatment program and three program administrators, as well as institutional texts, were analyzed to explore how institutional practices and (...) power relations co‐ordinated and managed nurses’ experiences. Analysis revealed the acritical acceptance of a standardized program not based on current norms of practice. Potential and actual conflicts of interest, power imbalances, and prevailing corporate interests were rife. Nurses were not afforded the same rights to quality ethical health care as other citizens. ‘Expert’ physicians’ knowledge was privileged while nurses’ knowledge was subordinated. Conclusions were that regulatory bodies cannot rely on the taken‐for‐granted standardized treatment model in widespread use. Individualized treatment alternatives reflecting current, scientific evidence must be offered to nurses, and nurses’ knowledge, expertise, and experiences need to be included in decision‐making processes in these programs. Review of Substance and Essence in Aristotle: an Interpretation of Metaphysics VII-IX, by Charlotte Witt (Cornell University Press: 1989).

Plato's most magisterial dialogue, the Republic, takes up the question "what is justice," and its central image is an imaginary city constructed in speech designed to aid in this inquiry. In Book V of the Republic, Socrates tells his interlocutors that they have completed the "Male Drama," of the city in speech and that it is now time for them to take up the "Female." The "Female Drama" is Socrates name for the action of the central books of the Republic: (...) V-VII. Much has been made of what this transition in the Republic signifies for political questions. The Republic is not only concerned with politics or political justice, however. Like all of the images and arguments in the Republic, the Female Drama of the city in speech has meaning both for political and individual justice, but there has been no systematic inquiry into the central books of the Republic for their meaning for individual justice. That is the ambition of this book. On the level of moral psychology, Thomas argues that while the Male Drama of Books II-IV presents images of fully formed versions of the psychological activities that come together to define justice in a human life, the Female Drama explores the modes of potentiality and becoming necessary for those psychological activities to come into being. More specifically, Books V-VII explore the three modes of potentiality necessary for the development of justice: genesis, trophe, and paideia. (shrink)

Problematic substance use (PSU) among nurses has wide‐ranging adverse implications. A critical integrative literature review was conducted with an emphasis on building knowledge regarding the influence of structural factors within nurses' professional environments on nurses with PSU. Five thematic categories emerged: (i) access, (ii) stress, and (iii) attitudes as contributory factors, (iv) treatment policies for nurses with PSU, and (v) the culture of the nursing profession. Conclusions were that an overemphasis on individual culpability and failing predominates in the literature and (...) that crucial knowledge gaps exist regarding the influence of structural factors on driving and shaping nurses' substance use. It is conventional to argue that the city-soul analogy of Plato’s Republic dominates Books ii through iv and viii through x but is absent in Books v through vii. We argue that the analogy remains operative in Books v through vii and that its role there, especially as it is played out in the motif of the three waves, illuminates its function in the dialogue as a whole, particularly with respect to the questions: What are the natural dispositions of soul (...) necessary for philosophy? THE MOST SACRED FREEDOM includes eight essays that were first presented at the 2014 A.V. Elliott Conference on Great Books and Ideas, the seventh annual conference sponsored by Mercer Universitys Thomas C. and Ramona E. McDonald Center for Americas Founding Principles. Together, these essays explore the great principle of religious liberty by charting its development in the Western tradition and reconsidering its place at Americas founding. The book begins with a comparison between the flood accounts in Genesis and the Mesopotamian (...) Atra-Has's and advances all the way to the 2014 Supreme Court case Burwell v. Hobby Lobby. The intervening chapters examine the contributions of figures such as Emperor Julian, Roger Williams, Cecilius Calvert, John Locke, Jean-Jacques Rousseau, and the American Founders. A signal challenge of twenty-first century psychiatry is the effective treatment of existential/spiritual suffering in palliative care. This chapter will concentrate on research to assess the therapeutic potential of psilocybin to assuage that suffering. If a “psychedelic experience” can facilitate an acceptance of impending death, and reduce the existential suffering of those who endure it, it could prove to be a valuable intervention where one is sorely needed. The therapeutic use of psilocybin with dying patients (hereinafter patients) raises numerous questions (...) about research trial design, the model of psychiatry that might accommodate it, and the kind of experience it induces. Are these the sorts of experience that psychiatric treatment should effect on troubled patients? Is spiritual care within the ambit of psychiatry? There are epistemological questions as to the veridicality of the psychedelic experience. How much credence should we give it? I will argue in cautious support of ongoing research to evaluate the therapeutic use of psilocybin in palliative care. This argument can be extended to research on its therapeutic use in psychotherapy. The chapter will focus on four questions: (1) what is the ethical justification for this research on patients? (2) What types of research trial design are best used to assess the purported benefits of a psychedelic drug experience? (3) What is the epistemic warrant of the “mystical” and “noetic” facets of this experience? (4) What models of (a) psychiatry and (b) drug action could accommodate the therapeutic use of psilocybin in palliative care? (shrink)

In ‘What is Enlightenment?’, Kant claims that no women are currently enlightened. Here I argue that this exclusion is due to certain legal restrictions guiding Kant’s conception of enlightenment. As enlightenment is intended to take place in society, it appears that Kant has a specific legal context in mind that affects its enactment. His twofold conception of citizenship and the dimension of subordination he puts forward by restricting the private use of reason will prove useful in clarifying those legal restrictions. (...) This article looks at the way the Brazilian writer and educator Nísia Floresta addresses issues of race and class within her construction of nationhood. This is achieved through a consideration of the specific subject of maternal breast-feeding as discussed by Floresta in two texts, written in Brazil and France, respectively. A comparison of these works reveals a very different engagement with race and class factors in determining women's claim to citizenship. Floresta, in common with early 19th-century European feminism, believed this (...) claim to lie within the domestic sphere, primarily in the role of mother and educator. The article considers how, as a vital aspect of that role, she portrays maternal breast-feeding as both natural and patriotic. It also highlights the extent to which Floresta was influenced by the prevailing concerns of her contemporaries regarding the risks of wet nursing and the threat posed by household slaves, before going on to consider how this discourse leads Floresta to exclude black slave women from her vision of patriotic motherhood, while acknowledging the maternity of women of all classes in a European context. Patriotic concerns, shaped by racial prejudices, overshadow Floresta's feminism, prohibiting the kind of unifying discourse of motherhood, which she claimed to profess. (shrink)

Owen Ware here develops and defends a novel interpretation of Fichte’s moral philosophy as an ethics of wholeness. While virtually forgotten for most of the twentieth century, Fichte’s System of Ethics is now recognized by scholars as a masterpiece in the history of post-Kantian thought and a key text for understanding the work of later German idealist thinkers. This book provides a careful examination of the intellectual context in which Fichte’s moral philosophy evolved and of the specific arguments he (...) offers in response to Kant and his immediate successors. A distinctive feature of this study is a focus on the foundational concepts of Fichte’s ethics—freedom, morality, feeling, conscience, community—and their connection to his innovative but largely misunderstood theory of drives. By way of conclusion, the book shows that what appears to be two conflicting commitments in Fichte’s ethics—a commitment to the feelings of one's conscience and a commitment to engage in open dialogue with others—are two aspects of his theory of moral perfection. The result is a sharp understanding of Fichte's System of Ethics as offering a compelling resolution to the personal and interpersonal dimensions of moral life. (shrink)

Hegel's interpretation of Plato's political thought provides the principal illustration of his metaphilosophy. However, Hegel has been criticized for imposing his own metaphilosophical agenda upon Plato's work, and for consequently overestimating its descriptive content while underestimating its prescriptively normative features. A reexamination of Hegel's metaphilosophy nevertheless reveals that he appreciated the broader significance of Plato's political philosophy within a conceptual framework that transcends the traditional dichotomy of description and prescription and that explores issues concerning the relation of theory and practice.

Kant’s doctrine of the Fact of Reason is one of the most perplexing aspects of his moral philosophy. The aim of this paper is to defend Kant’s doctrine from the common charge of dogmatism. My defense turns on a previously unexplored analogy to the notion of ‘matters of fact’ popularized by members of the Royal Society in the seventeenth century. In their work, ‘facts’ were beyond doubt, often referring to experimental effects one could witness first hand. While Kant uses the (...) German equivalent in different contexts, I argue that the scientific analogy opens up a new framework for interpreting his strategy of justification in the Critique of Practical Reason. In the final section, I address a few possible objections to my reading, one of which I anticipate coming from Dieter Henrich and Ian Proops, who have argued that Kant’s Fact of Reason is best understood under a legal analogy. Hegel is commonly understood to have required that the philosophy of history must be retrospective and therefore fundamentally conservative. Yet at the same time he is thought to have claimed that his system involved an absolute truth beyond which no philosophy could advance, and that it therefore marked the end of the history of philosophy. The two claims are evidently inconsistent, since a history of philosophy, which must be bound by constraints on the philosophy of history, could not legitimately comment (...) on philosophy's future. If this is the result of Hegel's metaphilosophy then he has contributed at least this much to his reputation for presumption and incoherence. However, I will argue that both claims are based upon misinterpretations that follow from inattention to Hegel's ontology, and that his metaphilosophy is more subtle and more critical than most interpreters have allowed. Though Hegel clearly requires that a philosophy draw its content from its time, he regards it as historically transcendent in its form, and as consequently playing a crucial role in the transition to the next historical epoch. The discussion begins with Hegel's views on the role of philosophy in history and proceeds to his conception of his place in the history of philosophy. (shrink)

Kamm's approach to patient selection qualifies the notion that fairness makes need for scarce, transplantable organs inversely proportional to age. She defines need as how much adequate conscious life a person will have had before death. Length of adequate conscious life correlates highly with age. If so, then younger persons are usually needier than older ones. Since Kamm allows for past periods of non‐adequate conscious life, I argue that this correlation may be neither as close, nor as easy to apply, (...) as she wants it to be. Fairness should require assessment of experiential content in determining how long one's life has been adequately conscious. I argue that such assessments involve some of the goods of experience and quality of life judgements that Kamm thinks a reliance on adequate conscious life will avoid. (shrink)

Kant’s arguments for the reality of human freedom and the normativity of the moral law continue to inspire work in contemporary moral philosophy. Many prominent ethicists invoke Kant, directly or indirectly, in their efforts to derive the authority of moral requirements from a more basic conception of action, agency, or rationality. But many commentators have detected a deep rift between the _Groundwork for the Metaphysics of Morals_ and the _Critique of Practical Reason_, leaving Kant’s project of justification exposed to conflicting (...) assessments and interpretations. In this major re-reading of Kant, Owen Ware defends the controversial view that Kant’s mature writings on ethics share a unified commitment to the moral law’s primacy. Using both close analysis and historical contextualization, Owen Ware overturns a paradigmatic way of reading Kant’s arguments for morality and freedom, situating them within Kant’s critical methodology at large. The result is a novel understanding of Kant that challenges much of what goes under the banner of Kantian arguments for moral normativity today. (shrink)

InThe Second Sex, Simone de Beauvoir argues that women are often complicit in reinforcing their own unfreedom. But why women become complicit remains an open question. The aim of this article is to offer a systematic analysis of complicity by focusing on the Heideggerian strands of Beauvoir's account. I begin by evaluating Susan James's interpretation of complicity qua republican freedom, which emphasizes the dependent situation of women as the primary cause of their complicity. I argue that James's analysis is compelling (...) as far as it goes, but that it implies complicity is the inevitable outcome of women's current existence and fails to adequately account for Beauvoir's claim that women actively embrace their own unfreedom. I then draw out the Heideggerian strands of Beauvoir's analysis, demonstrating how this enables us to systematize Beauvoir's account of women's oppressive situation with her claims regarding the active role women can play in reinforcing their own unfreedom. I argue that this approach preserves the strengths of the republican interpretation, but provides a better account of cases where complicity may not be inevitable and yet some women still act to reinforce rather than resist their own unfreedom. This paper examines Fichte's proof of evil in §16 of the System of Ethics. According to the majority of commentators, Fichte was mistaken to consider his proof Kantian in spirit (Piché 1999; Kosch 2006, 2011; Dews 2008; and Breazeale 2014). For rather than locate our propensity to evil in an act of free choice, Fichte locates it in a natural force of inertia. However, the distance between Kant and Fichte begins to close if we read his concept of inertia, not (...) as a material force, but as a tendency to resist the work of agency and autonomy. There are, I argue, both textual and conceptual reasons in support of a figurative interpretation. In the course of presenting these reasons, I also uncover an important insight guiding Fichte's analysis of evil in the System of Ethics: namely, his claim that we can never fully step back from ourselves in reflection. In the concluding sections of the paper, I argue that Fichte's insight may solve a particular skeptical threat facing recent Kantian accounts of normativity. (shrink)

This paper addresses the actual practice of justifying definitions in mathematics. First, I introduce the main account of this issue, namely Lakatos's proof-generated definitions. Based on a case study of definitions of randomness in ergodic theory, I identify three other common ways of justifying definitions: natural-world justification, condition justification, and redundancy justification. Also, I clarify the interrelationships between the different kinds of justification. Finally, I point out how Lakatos's ideas are limited: they fail to show how various kinds of justification (...) can be found and can be reasonable, and they fail to acknowledge the interplay among the different kinds of justification. My aim in this chapter is to address what looks like a tension in Fichte’s derivation of ethical content for the moral law in his System of Ethics. In the first place, Fichte seeks to derive the content of our duties from our “natural drive [Naturtrieb],” which he defines in terms of our striving for enjoyment. But later in the book we find a second argument that derives the content of our duties from what Fichte calls the conditions of our (...) “I-hood [Ichheit],” namely, our embodiment, intelligence, and sociality. I argue that a careful rereading of Fichte’s notion of a natural drive is consistent with this second derivation. The key to this reading lies in Fichte’s effort to reframe the natural drive through the category of “reciprocal interaction [Wechselwirkung],” which allows us to view the natural drive as a “formative drive [Bildungstrieb]” that is both active and passive. For Fichte, the formative drive amounts to a striving for self-organization, and this striving, I argue, prefigures what becomes the ethical drive to engage in reciprocal interaction with other members of the rational community. In his article ‘On the shoulders of giants', Don Fowler argues for the identification of the Aeneid with its opening arma, saying that in post-Augustan Latin verse arma is always seen as significantly intertextual. The word may apply to the Aeneid itself, or, more generally, to imperial epic or epic in the style of Virgil.

Kant’s effort to defend the co-existence of transcendental freedom and natural necessity is one of the crowning achievements of the first Critique. Yet by identifying the will with practical reason in his moral philosophy, he lent support to the view that the moral law is the causal law of a free will – the result of which, as Reinhold argued, left immoral action impossible. However, Reinhold’s attempt to separate the will from practical reason generated difficulties of its own, which Maimon (...) was quick to point out. By identifying freedom with indifferent choice, Maimon argued, Reinhold had no resources to explain why a free will acts at all. My aim in this article is to show how Fichte’s theory of freedom seeks to reconcile these two commitments: the key lies in what I call Fichte’s Genetic Model, according to which indifferent choice is the original condition of the will, but a condition we must actively overcome. In the development of governmental policy for artificial intelligence that is informed by ethics, one avenue currently pursued is that of drawing on “AI Ethics Principles”. However, these AI Ethics Principles often fail to be actioned in governmental policy. This paper proposes a novel framework for the development of ‘Actionable Principles for AI’. The approach acknowledges the relevance of AI Ethics Principles and homes in on methodological elements to increase their practical implementability in policy processes. As a case study, elements (...) are extracted from the development process of the Ethics Guidelines for Trustworthy AI of the European Commission’s “High Level Expert Group on AI”. Subsequently, these elements are expanded on and evaluated in light of their ability to contribute to a prototype framework for the development of 'Actionable Principles for AI'. The paper proposes the following three propositions for the formation of such a prototype framework: preliminary landscape assessments; multi-stakeholder participation and cross-sectoral feedback; and, mechanisms to support implementation and operationalizability.
